Terms of Service

These Terms of Service ("Terms") govern your use of the Poo Ping mobile application ("App") operated by Digital Space Tech (ABN 62 129 288 610) ("we", "us", or "our"), a business registered in Victoria, Australia. Our website is digital-space.au.

By creating an account or using the App you agree to these Terms. If you do not agree, do not use the App.

1. Eligibility

You must be at least 13 years old to use Poo Ping. By using the App you confirm that you meet this requirement. If we learn that a user is under 13 we will delete their account and data without notice.

2. Your Account

  • You are responsible for keeping your login credentials secure.
  • You must provide accurate information when registering (display name, username, email).
  • One person may hold one account. You may not transfer your account to another person.
  • You may delete your account at any time from Settings > Delete Account. Account deletion is processed within 30 days.

3. Acceptable Use

You agree not to:

  • Use the App for any unlawful purpose or in violation of any applicable law.
  • Harass, bully, threaten, or abuse other users.
  • Post or transmit content that is defamatory, obscene, sexually explicit, or hateful.
  • Impersonate another person or entity.
  • Attempt to gain unauthorised access to any part of the App or its infrastructure.
  • Use automated scripts, bots, or scrapers on the App.
  • Sell, trade, or transfer your account or any in-app credits to another person.

We reserve the right to suspend or terminate accounts that violate these rules.

4. User Content

You retain ownership of content you create (messages, photos, profile information). By submitting content to the App you grant us a non-exclusive, royalty-free, worldwide licence to store, display, and transmit that content solely for the purpose of operating the App.

You are solely responsible for your content. We do not pre-screen content but reserve the right to remove any content that violates these Terms or applicable law.

5. In-App Purchases

The App offers optional purchases of virtual credits ("Credits") through Apple's App Store. Credits are consumable and have no monetary value outside the App. All purchases are:

  • Final and non-refundable, except as required by applicable law or Apple's refund policies.
  • Subject to Apple's terms of service in addition to these Terms.
  • Processed by Apple; we do not store your payment card details.

Credits are tied to your account and will be lost if you delete your account.

6. Intellectual Property

All App content not created by users — including designs, logos, illustrations, software, and the "Poo Ping" name — is owned by or licensed to Digital Space Tech and may not be copied, modified, or distributed without our written permission.

7. Privacy

Your use of the App is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

8. Disclaimers

The App is provided "as is" and "as available" without warranties of any kind, express or implied, to the fullest extent permitted by law. We do not warrant that the App will be uninterrupted, error-free, or free of harmful components.

9. Limitation of Liability

To the fullest extent permitted under Australian law, Digital Space Tech's total liability to you for any claim arising out of or relating to the App is limited to the amount you paid us in the 12 months preceding the claim, or AUD $10, whichever is greater. We are not liable for any indirect, incidental, special, or consequential loss.

Nothing in these Terms excludes any consumer guarantee under the Australian Consumer Law that cannot lawfully be excluded.

10. Third-Party Services

The App integrates with third-party services including Google Firebase, RevenueCat, and Klipy. Your use of those services is subject to their respective terms and privacy policies. We are not responsible for the practices of those third parties.

11. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes via an in-app notice or email. Continued use of the App after the effective date constitutes acceptance of the revised Terms.

12. Termination

We may suspend or terminate your access to the App at any time if you breach these Terms or if we decide to discontinue the App. You may stop using the App at any time.

13. Governing Law

These Terms are governed by the laws of Victoria, Australia. Any dispute will be subject to the non-exclusive jurisdiction of the courts of Victoria, Australia.
